Terms and Conditions for Track Uploads

1. Purpose of Upload

By uploading a Track, You agree that its use is strictly limited to testing purposes within the PlusMetrica platform. This includes the collection of reviews, ratings, and analytical insights from our community of reviewers. Tracks will not be publicly shared, sold, redistributed, or disclosed beyond this purpose.

2. Security and Distribution Technology

All Tracks are streamed using HTTP Live Streaming (HLS) technology, ensuring secure delivery. No direct download or unauthorized duplication is permitted. The Platform has taken reasonable technical and organizational measures to ensure the Tracks are protected during this limited-use testing.

3. Ownership and Rights

Artists: You affirm that you are the rightful owner of the uploaded Track(s) and hold all necessary rights (including copyright and related rights) to submit the Track for the stated testing purpose.

Distributors: If you are a distributor, you affirm that you have obtained explicit permission from the rightful artist(s) or rights holder(s) to upload the Track for testing on their behalf.

PlusMetrica S.L. assumes no responsibility for Tracks submitted without proper authorization and reserves the right to remove any content in case of rights infringement.

4. License Grant

You grant PlusMetrica S.L. a limited, non-exclusive, royalty-free, and revocable license to use, stream, analyze, and display the Track solely for internal testing and review purposes. This license automatically terminates when the testing period concludes or upon your written request, whichever comes first.

5. Pricing, Promotions, and Scope of Testing

First Track Test: Your first track analysis is completely free and includes 25 fan reviews, a track score, genre ranking, word cloud, and full written feedback. You may optionally upgrade to a premium report for an additional fee, but it is not required.

Pricing Information: Service fees are based on the number of reviews selected (50, 100, or 200). Full pricing details are always available on our Pricing Page.

Discounts: Promo codes may apply partial or full discounts on the standard price.

Test Volume: The scope of the test (number of reviews, data provided) will be explicitly stated prior to order confirmation.

PlusMetrica S.L. reserves the right to modify pricing and promotional terms at any time, but changes will not affect existing or in-progress campaigns.

6. Confidentiality and Non-Disclosure

PlusMetrica S.L. agrees not to disclose, share, or commercialize any uploaded Track beyond the internal testing and analytics described herein. The contents, metadata, and analytics derived from the Track remain confidential and will not be sold or publicly displayed.

7. Termination and Content Removal

You may request removal of your Track at any time by contacting our support team. Upon request, we will remove the Track from our systems within a commercially reasonable timeframe, and the license granted under Section 4 will be terminated.

8. Limitation of Liability

PlusMetrica S.L. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Platform, including but not limited to data loss, unauthorized access due to user negligence, or third-party actions.

9. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Spain. Any dispute arising under these Terms shall be submitted to the exclusive jurisdiction of the courts located in Madrid, Spain.
